Terms of Service

These Terms of Service (“Terms”) govern your use of the OuBiznes.mu platform (“Platform” or “Service”), operated by OuBiznes, Quatre Bornes, Republic of Mauritius (“we”, “us”, “our”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Description of Service

OuBiznes provides free AI-powered tools for Mauritian small and medium enterprises (SMEs), including but not limited to: AI Website Builder, Business Plan Generator, Content Studio, PAYE/CSG Calculator, VAT Calculator, Salary Calculator, and Business Pulse. The Service is provided free of charge on the free tier with usage limits per tool per day.

2. Eligibility

You must be at least 18 years old to create an account. By using the Platform you represent that you are of legal age and have full authority to agree to these Terms on behalf of yourself or the business entity you represent.

3. Account Registration

You may register using an email address and password, or via Google OAuth.
You are responsible for maintaining the confidentiality of your credentials.
You must provide accurate and up-to-date information in your profile.
You are responsible for all activities that occur under your account.
Notify us immediately at contact@oubiznes.mu if you suspect unauthorised use.

4. Acceptable Use

You agree not to:

Use the Platform for unlawful, fraudulent, or misleading purposes.
Resell or commercially redistribute AI-generated outputs to third parties as if they were your own original work without disclosure that they are AI-generated.
Attempt to reverse-engineer, scrape, or circumvent rate limits or security measures.
Upload or input content that is defamatory, offensive, infringing, or violates any law.
Use automated bots to interact with the AI tools.
Impersonate any person or entity or misrepresent your affiliation.

We reserve the right to suspend or terminate accounts that breach these obligations without notice.

5. AI-Generated Content Disclaimer

All outputs produced by our AI tools — including business plans, website text, marketing copy, and tax or payroll estimates — are provided for informational and guidance purposes only. They do not constitute professional legal, financial, tax, or accounting advice.

You should independently verify all figures with a qualified professional (accountant, lawyer, MRA-registered tax agent) before making business decisions or filing regulatory submissions. We accept no liability for decisions made solely on the basis of AI-generated content.

AI models can produce inaccurate or outdated information. Always review outputs carefully before publishing or sharing them.

6. Free Tier Limits

The free tier allows a limited number of AI generations per tool per 24-hour period (currently 2–3 depending on the tool). Limits may change with notice. Abuse of the free tier, including using multiple accounts to circumvent limits, is prohibited.

7. Intellectual Property

Platform IP: The Platform, its code, design, and all non-user content are owned by OuBiznes and protected by Mauritius intellectual property law.

User inputs: You retain ownership of text and materials you submit to the Platform. By submitting content, you grant us a limited, royalty-free licence to process it solely to deliver the requested AI output.

AI outputs: We make no claim of ownership over AI-generated content produced from your inputs. Use and commercialise outputs in accordance with applicable law and the terms of the AI model providers (currently Google Gemini).

8. Data Protection

Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms. We process personal data in accordance with the Data Protection Act 2017 (Mauritius).

9. Availability and Modifications

We do not guarantee uninterrupted or error-free access to the Platform. We may modify, suspend, or discontinue any feature or the entire Service at any time with reasonable notice where practicable. We are not liable for any interruption or cessation of the Service.

10. Limitation of Liability

To the fullest extent permitted by Mauritius law, OuBiznes and its operators shall not be liable for:

Loss of profits, revenue, business, or data.
Decisions made on the basis of AI-generated content.
Indirect, consequential, or incidental damages of any kind.
Any damage arising from third-party service failures (Supabase, Vercel, Google).

Our total aggregate liability to you for any claim arising out of or relating to the Platform shall not exceed Rs 1,000 (one thousand Mauritian rupees).

11. Indemnification

You agree to indemnify and hold harmless OuBiznes from any claims, losses, or expenses (including reasonable legal fees) arising from your use of the Platform, your inputs, or your breach of these Terms.

12. Account Termination

You may delete your account at any time via oubiznes.mu/dashboard/delete-account. Upon deletion, all your personal data, business profile, and saved sites are permanently erased. We may also suspend or terminate accounts that violate these Terms.

13. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Republic of Mauritius. Any disputes shall be subject to the exclusive jurisdiction of the courts of Mauritius. We encourage you to contact us first at contact@oubiznes.mu to resolve disputes amicably.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of the Platform after the effective date of any update constitutes your acceptance of the revised Terms. Material changes will be communicated by email or a prominent notice on the Platform.
